General terms and conditions

These general terms and conditions of ADVENTICA e-shop (hereinafter referred to as "Terms and Conditions") apply to purchases of Goods made on the website www.adventica.de.

We recommend that you read these Terms and Conditions carefully before using our online store. We reserve the right to change these Terms and Conditions without prior notice.

1. Definitions of terms

ADVENTICA means the company Freudig GmbH, HRB 38133 / Rhein-Ruhr Zentrum, Humboldtring 13, 45472 Mülheim an der Ruhr, Deutschland. 

Park ADVENTICA means the business premises of Freudig GmbH, marked "ADVENTICA" at Rhein-Ruhr Zentrum, Humboldtring 13, 45472 Mülheim an der Ruhr, Deutschland. 

Terms of Personal Data Protection means the personal data protection conditions available on the advetnica.de website

Entrepreneur means a natural or legal person who, when concluding and fulfilling a contract, acts within the scope of his business activity, employment or profession

Payment Method means one of the payment methods chosen by the Customer in the order creation process, the payment methods are defined in Article 2 of the Terms and Conditions

Goods mean a ticket, reservation or gift voucher

Customer means any person who actually uses the services of the Operator; if the Customer is a minor, the Customer means an adult accompanying the Customer or his legal representative, as well as the person who ordered ADVENTICA’s services.

The relationship between ADVENTICA and the Customer is governed by the provisions of German law, in particular the Bürgerliches Gesetzbuch (BGB – German Civil Code), the Einführungsgesetz zum Bürgerlichen Gesetzbuche (EGBGB – Introductory Act to the Civil Code), the Telemediengesetz (TMG – Telemedia Act), the Gesetz gegen den unlauteren Wettbewerb (UWG – Act Against Unfair Competition), as well as the Datenschutz-Grundverordnung (DSGVO/GDPR) and the Telekommunikation-Telemedien-Datenschutz-Gesetz (TTDSG – Telecommunications-Telemedia Data Protection Act).

2. Payment Methods

  1. ADVENTICA offers its Customers the following payment methods:
  • Stripe payment system (Visa, MasterCard, Maestro)
  • SEPA bank transfer

All payments are processed in euros. If the Customer’s card or bank account is denominated in another currency, the transaction amount will be converted according to the exchange rate and rules of the issuing bank on the day of settlement, at the Customer’s expense.

Payment is due immediately upon conclusion of the order process, unless otherwise expressly agreed. Payments via Stripe are processed securely; ADVENTICA does not store or process Customers’ complete payment data.

In accordance with § 270a BGB, Customers will not be charged any additional fees for the use of a particular payment method beyond the actual costs incurred by ADVENTICA.

3. Methods of transport

Since ADVENTICA offers Goods of an intangible nature, the Goods are delivered to the Customer exclusively electronically to an e-mail address.

4. Ordering the Goods

When ordering Goods on the website www.adventica.de, the Customer is obliged to provide the following information: Goods, quantity of Goods, first and last name, residential address, telephone number, e-mail address.

A Customer who is an Entrepreneur is obliged to state the name of the company, ID number, registered office or place of business and, if he is a VAT payer, also the VAT ID number. In the case of an Entrepreneur based abroad, ADVENTICA reserves the right to request to provide additional proof of the data provided in the order.

The Customer is obliged to choose a Payment Method.

Before confirming the order, the Customer is obliged to carefully check the contents of his order, the total price of the order and express his agreement with the Terms and Conditions and Terms of Personal Data Protection by ticking the box.

After clicking on the "Order with payment obligation" button, the Customer will be redirected to the payment gateway depending on the selected Payment Method. In it, the Customer will enter the data necessary to make the payment: the name on the payment card, the payment card number, its validity date and the CCV verification code, and will proceed according to its instructions.

ADVENTICA is not responsible for any malfunctions during the online card payment process. When paying, the Customer is responsible for having sufficient authorization to use the payment card, as well as for the correctness of the data provided. The Customer is also responsible for any damages that arise as a result of the wrong e-mail address being entered in the order.

After completing the purchase, the Customer will be shown the following purchase data: order identification number and order time. The Customer will then receive a confirmation e-mail with a summary of the order and information about the processing of the order in the attachment of the confirmation e-mail to the e-mail address specified in the order. If the Customer chooses the method of payment via bank transfer, he will also receive the necessary payment data for making the bank transfer.

After processing the order and crediting the price for the order to ADVENTICA's account, usually within 24 hours from the day of receipt of the order, the Customer will receive the Goods and an electronic invoice to the specified e-mail address. We send tickets and gift vouchers to Customers in electronic form, which contain a QR code, which the Customer will use to identify himself when entering the Park ADVENTICA. The Customer can also print the ticket with the QR code.

5. Withdrawal from the purchase contract

The Customer has no right of withdrawal if the contract concerns services in connection with leisure activities and provides for a specific date or period of performance. This applies in particular to the purchase of tickets or services for visits to ADVENTICA parks, as these are time-bound leisure services. The statutory provision of § 312g (2) no. 9 BGB (German Civil Code) applies.

At its sole discretion, ADVENTICA may offer replacement goods or services (e.g., vouchers or alternative dates) as a gesture of goodwill. The Customer, however, has no legal entitlement to such compensation.

6. Alternative dispute resolution

ADVENTICA undertakes to resolve potential disputes with Customers primarily by mutual agreement to the Customer's satisfaction. In case of any disputes or violation of the Customer's rights, please contact our customer support at [email protected] or at +49 15161594317

If ADVENTICA (i) fails to resolve the disputed event in a proper and timely manner or (ii) rejects the Customer's claim or (iii) rejects or fails to remedy the perceived violation of the Customer's rights, the Customer shall have the right to resolve the dispute out of court by contacting an alternative dispute resolution entity. 

7. Final Provisions

These Terms and Conditions are available on the website www.adventica.de A printed copy of the currently valid provisions of these Terms and Conditions is publicly available at the entrance to Park ADVENTICA.

All matters not regulated by these Terms and Conditions are governed by the laws of Germany.
